Man sentenced for assault, harassment and threats

Miller gets time served plus five days, 18 months probation

A man was given a jail sentence and probation after pleading guilty on Monday to three separate and seemingly unrelated incidences of harassment, assault and threats to cause bodily harm.

Dustin Miller, 34, was charged with harassment in January for sending his ex-girlfriend 156 text messages in which he threatened to take her children and made “odd remarks involving demons.”

On July 24 in a different incident, Miller chased a woman and her child into the woman’s home and threatened to “pound on their faces.” He then took out his phone and began photographing the house.

The woman’s husband left the house to follow Miller and keep an eye on him, but Miller threatened to shoot the husband. Miller did not have a gun, but the husband retreated until RCMP arrived to arrest Miller.

He was charged with threats to cause bodily harm for the incident.

In October, Miller was charged with assault when he kicked a man in the back. The man was walking home, and knew Miller from a previous interaction.

Miller has been in custody since the charge was laid in that incident.

During sentencing, the Crown argued for a sentence of 90 days in jail and 18 months probation.

Miller’s lawyer acknowledged the offences seemed to “be in a new category” in comparison to Miller’s previous run-ins with the law. However, he argued at the time of the crimes Miller was living on the streets, not taking his medication for schizophrenia, and using street drugs.

Justice Bruce R. Garriock sentenced Miller to an additional five days beyond the time spent in custody since his Oct. 18 arrest. In addition to his jail sentence, Miller received 18 months of probation and is forbidden from contacting any of his victims.
