Man gets jail, probation for axe assault

A man who swung an axe into his friend’s forearm after a night of drug use was sentenced to a year in jail and a year of probation.

A man who swung an axe into his friend’s forearm after a night of drug use was sentenced to a year in jail and a year of probation.

Ocrame Moghrabi, 50, pleaded guilty to one count of assault with a weapon and one count of failing to appear in court when he received the sentence on Monday.

He has been in custody since May 2009 and, due to a two-for-one credit for time served, was released. Moghrabi will be on a strict probationary term for the next 12 months.

Moghrabi was at his victim’s home smoking cocaine when, at around 6 a.m. on May 18, 2008 the pair got into an argument.

Moghrabi hit his victim in the head, knocking him to the ground. He left the room briefly and returned with an axe, which he used to strike a blow to the victim’s forearm, leaving a deep gash.

The victim reported the incident about 12 hours later, when he walked into the RCMP detachment and told officers the entire story.

Moghrabi missed his original trial date and police picked him up on a warrant.

Through his lawyer, Moghrabi told the court he had a serious alcohol and drug problem and was eager to turn his life around. He said he would be entering a residential treatment program upon his release from jail where they were holding a bed for him.

During his probationary term Moghrabi must have no contact with the victim and attend drug counselling if his probation officer recommends it.

He was also handed a five-year weapons ban.
